Terms & Conditions

VNS-Europe Field Assessors would like to draw your attention to the following points:
1. 0ur vehicle inspections are prepared from visual and external checks only and are limited to the parts and/or items identified and do not involve dismantling or disturbing of any structure, assembly, component or internal mechanism. Any items that are not reasonably accessible on the vehicle will not be inspected. In such circumstances we will be under no obligation to inspect and/or report on the part/item in question and will mark the relevant section of the report accordingly.
2. Any car data checks are conducted using information supplied HPI and VNS-Europe cannot be held liable for any losses resulting from such checks. VNS-Europe will only advise of information held by third parties that could be detrimental to a purchase of a vehicle.
VNS-Europe cannot guarantee this information as accurate or complete.
3. We do not check:
a. Oil and fuel consumption.
b. Source of oil leaks.
C. Brake lining material, unless clearly visible without dismantling anything.
d. Brake fluid for contamination. (Brake fluid will deteriorate over a period of time and we advise that it be replaced as recommended by the vehicle manufacturer).
e. Operation of cassette, compact disc players or other in car entertainment,
sound or radio reception, alarm systems and non standard accessories.
f. Cylinder compression.
g. Air conditioning function and efficiency by the use of specific diagnostic equipment.
h. Vehicle electrics and electronics by the use of specific diagnostic equipment.
I. The accuracy of in-car computer systems or instruments (for example, but in no
way restricted to, computers used for route finding, fuel efficiency or otherwise).
j. Exhaust emissions and or catalytic converters, using gas analysing equipment.
k. Internal workings of Turbo units and seals.
4. Our vehicle inspections can only describe and/or identify defects actually found and/or which are reasonably capable of being found upon external visual consideration of the vehicle at the time of inspection. We cannot be held and are not responsible for any latent defects which are later discovered. (We cannot advise of defects if we cannot see them, or they are not apparent during inspection of the vehicle concerned.)
In particular please note that (without limiting the possibility to such vehicles) vehicles over 5 years old, those that have a high mileage or which have been subjected to abnormal use may have latent defects. Whilst such defects may, in appropriate circumstances, give rise to a claim against a vehicle supplier they fall outside the scope of our reports and our reports are provided to, and accepted by, customers on this basis.
5. Please note that the life expectancy of any part/item is uncertain and difficult to predict and we do not give or imply any duration of life expectancy.
6. Any estimates for repair/rectification given by a VNS-Europe Field Assessor or our representative are a subjective opinion and are given solely as a matter of goodwill. Customers should not rely on such estimates in making any decision and an appropriate repairer before purchase should verify such estimates.
7. Road testing is carried out within the immediate area of the vehicle check. If, due to circumstances outside of our reasonable control, a road test cannot be carried out at the time of inspection the original fee shall remain fully payable and an additional fee will be payable for any subsequent road test we are asked to undertake. The customer is required to inform us if a vehicle does not have a valid CT/MOT certificate or country equivelent; we will not be obliged to carry out a test drive if the vehicle does not have a valid CT/MOT or country equivelent certificate.
8. We reserve the right to charge you half of the fee if, due to circumstances outside of our reasonable control, we are unable to carry out the vehicle inspection on arrival at the location.
We shall not be liable for any delay in performing, or any failure to carry out a vehicle inspection to the extent that such delay or failure results from events or circumstances outside our reasonable control.
9. We shall not, in any event, have any liability or responsibility for any loss of profits, economic loss, loss of business and loss of goodwill (in all these cases whether direct or indirect) nor for any indirect, purely economic or consequential losses incurred as a result of or in connection with any Car Inspection Advanced Check (including any non-occurrence thereof), whether resulting from breach of contract, negligence, breach of statutory duty or otherwise.
10. Our vehicle inspections are supplied solely for the use of the customer and are not for the use of, or to be relied upon by, any third party and the customer shall be responsible for advising any such third party accordingly. For the avoidance of doubt, under no circumstances will VNS-Europe be liable to any third party in contract, tort (including negligence) or otherwise for any loss (direct, indirect or consequential) which any third party may incur as a result of any information supplied by the our vehicle inspection (save for any liability for death or personal injury caused directly by the negligence of VNS-Europe).
11. Nothing herein will affect the statutory rights of a consumer under any applicable statute nor operate so as to exclude or limit or liability for death or personal injury caused by our negligence.
12. If any part of these terms and conditions are held by a court of competent jurisdiction to be unenforceable the validity of the remainder of the terms and conditions will not be affected.
13. These terms and conditions are governed by the laws of France and the Customer hereby irrevocably submits to the exclusive jurisdiction of the European and French courts.
14. In the event of dissatisfaction please contact on +33 0685 810 283. In the event of dissatisfaction we reserve the right to re-examine the vehicle PRIOR to any rectification being made.
15. In the event that anyone acts in an abusive or threatening manner to a member of VNS-Europe we reserve the right to cease or cancel any conversation/transaction or inspection and, if applicable, the terms & conditions of our cancellation fee will be enforced.
16. Force Majeure
We are not responsible for any loss, damages, costs, claims or expenses which you may incur as a result of our delay in or failure to perform our obligations where such delay or failure is due to causes beyond our control. Causes beyond our control include: fire, flood, earthquake, accident, civil disturbances, war, rationing or embargoes, strikes, labour problems, delays in transportation, inability to secure necessary materials, delay or failure of performance of any supplier or subcontractor, acts of God and acts of Government.
17. In the event of an invoice not being paid within the specified time as indicated on every invoice, a 10% service charge will be added after the due date has expired, up until the 30th day, after which an additional service charge of 25% will be applied to the outstanding balance. An instruction or request to inspect a vehicle is considered as an acceptance of the VNS-Europe Terms and Conditions in their entirety.
18. Payment for services provided by VNS-Europe in France can only be accepted in Euros.
